Set out below are the TERMS AND CONDITIONS (the "Terms") you are agreeing to when you use the CodeGuesser website at www.CodeGuesser.co.uk (the "Site"), which is owned and operated by eCompare Ltd ("We or Us"), a Limited Company registered in England and Wales with Company Number 11155291. You should read and ensure that you understand all of these Terms prior to using the Site. By using this Site, you agree to be bound by these Terms, and if you do not agree to be bound by these Terms then you should discontinue your use of the Site immediately.
Accuracy of information
Some of the data We provide to you, such as voucher codes and information about merchant's offers, are provided by third parties and therefore we offer no guarantee that this information is valid. You are advised to check that any applicable discounts having been applied prior to committing to any purchase in connection with the Site. Unless otherwise specified, you are expressly prohibited from reproducing, copying, editing, transmitting, uploading or incorporating into other materials any voucher code marked as "Exclusive".
These Terms shall be governed by and construed in accordance with laws of England and Wales. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. By accepting these Terms you submit to the non-exclusive jurisdiction of the English courts.
The agreement between us
By visiting and using the Site, you warrant that you are at least 18 years old and have the right, authority and capacity to enter into and be bound by these Terms and that you agree to be bound by these Terms forthwith. In the event that CodeGuesser, in its sole discretion, considers that your usage of of the Site is illegal or unlawful, and/or your use of the Site is in direct or indirect breach of these Terms, then CodeGuesser reserve the right to take any action that We deem necessary, including but not limited to: terminating or blocking without notice your use of the Site and, in the case of illegal use, instigating court proceedings. CodeGuesser may suspend the Site at any time and for any reason whatsoever; including but not limited to: repairs, planned maintenance or upgrades. We shall not be liable to you for any such suspension in service.
Warranties & Indemnities
CodeGuesser provides users with access to the Site free of charge and We shall not be liable in contract, tort (including negligence) or otherwise for any loss, injury or damage of whatever kind caused in whole or in part by use of the Site or the information provided therein, or by any failure, delay, interruption or otherwise of the provision of the Site or the information provided therein, or by CodeGuesser's failure to perform any of its obligations under these Terms. The material on the Site is provided on an "as is" basis, without any conditions, warranties or other terms of any kind. We do not guarantee that the Site, or any content on it, will be free from errors or omissions or that the Site, or any content on it, will always be available or be uninterrupted. Access to the Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We will not be liable to you if for any reason the Site is unavailable at any time or for any period. In no event shall CodeGuesser be liable in contract, tort (including negligence) or otherwise for any loss of profits, goodwill, savings or business (whether any of the foregoing are direct or indirect), or for any special, indirect, incidental or consequential damages. CodeGuesser will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any content on it, or on any website linked to it or to any email sent by CodeGuesser to you. If any provision of these Terms is declared void, illegal or unenforceable, the remainder of these Terms will be valid and enforceable to the extent permitted by applicable law. In such event, the parties agree to use their best efforts to replace the invalid or unenforceable provision by a provision that, to the extent permitted by the applicable law, achieves the purposes intended under the invalid or unenforceable provision.
